CapTech trademarks may not be used without first obtaining written permission from CapTech. All other trademarks, product names, and company names and logos appearing on the Site are the property of their respective owners.
The information and materials provided on this Site (the "Content") is provided as a service to CapTech's clients and potential clients. You may only access, print, and use the Content if you include and retain all proprietary rights notices appearing on such materials, and your use is restricted to your or your company's own internal use, and you do not use it for any public or commercial purposes. You may not copy, distribute, or create derivative works from the Content. You agree to abide by all additional restrictions displayed on this Site as it may be updated from time to time.
The content may contain inaccuracies and typographical errors. CapTech does not want you to, and you should not, send any confidential or proprietary information to CapTech via the Site. You agree that any information or materials that you or individuals acting on your behalf provide to CapTech will not be considered confidential or proprietary, and you further agree that CapTech is free to use any ideas, concepts or know-how that you or individuals acting on your behalf provide to CapTech.
Limitation of Liability
In no event shall CapTech or any of its subsidiaries be liable to any entity for any direct, indirect, special, consequential or other damages (including, without limitation, any lost profits, business interruption, loss of information or programs or other data) that are related to the use of, or the inability to use, the content and functions of the site or any linked website whether based on breach of contract, breach of warranty, tort, negligence, product liability or otherwise, even if advised of the possibility of such damage.
CapTech reserves the right, in its sole discretion, to modify any and all portions of the Site without notice. Changes in this Agreement will be effective when notice of such change is posted. Your continued use of the Site after any changes to this Agreement are posted will be considered acceptance of those changes.
These Terms and Conditions of use shall be governed by the laws of the Commonwealth of Virginia, without giving effect to its conflict of laws provisions. This Agreement constitutes the entire agreement between CapTech and you with respect to your use of the Site. Any cause of action you may have with respect to your use of the Site must be commenced in a federal or state court of competent jurisdiction in the Eastern District of Virginia within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Agreement or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect.
When accessing our Site, CapTech will learn certain information about you during your visit.
Similar to other commercial web sites, our Site utilizes a standard technology called "cookies" (see explanation below, "What Are Cookies?") and web server logs to collect information about how our Site is used. Information gathered through cookies and web server logs may include the date and time of visits, the pages viewed, time spent at our web site, the web sites visited just before and just after our web site, and your IP address.
What Are Cookies?
A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a web site, that site's computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. How Do We Use the Information That You Provide to Us?
Broadly speaking, we use personal information for purposes of administering our business activities and providing client service.
CapTech will not obtain personally-identifying information about you when you visit our Site, unless you choose to provide such information to us, nor will such information be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection.
We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of our legal rights.
How Do We Protect Your Information and Secure Information Transmissions?
Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email. However, doing so is allowed, but at your own risk. Some of the information you may enter on our Site may be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information should never be transmitted via email.
CapTech may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our Site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.
For site security purposes and to ensure that this service remains available to all users, CapTech uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.
We may place pixels from DoubleClick, or other ad serving platforms in order to collect first-party cookie data for use with ad retargeting. This allows us to provide targeted advertising in the future. If you do not wish to receive this type of advertising from us in the future, you can opt out using the DoubleClick opt-out page or the Network Advertising Initiative opt-out page.
